We are counsel for Matt Groening. He has forwarded to us the above-referenced matter for handling.

Since in or about 1980, Mr. Groening has used his name and his own handwriting (including signature), which is trademarked, distinct and famous, in connection with many ventures, including LIFE IN HELL comic strips and comic books and THE SIMPSON'S television show. Mr. Groening has expended tremendous time- and effort to protect his trademarks, name and handwriting. As a result of these efforts, the trademarks, Mr. Groening's name and his handwriting have developed extraordinary goodwill in the marketplace and are associated with Mr. Groening.

The above-referenced website contains a webpaqe with a program which invites the user to replicate Mr. Groening's own handwriting (including signature) . The webpage also repeatedly uses Mr. Groening's name and replicates his own handwriting (including signature).

This webpage violates Section 3344 of the California Civil Code by using Mr. Groening's name and replicas of his handwriting, violates Mr. Groening's common law right of publicity for the same reasons, infringes and dilutes Mr. Groening's registered and unregistered trademarks, interferes with certain of Mr. Groening's business relationships and prospective economic advantage, violates the California unfair competition statute, constitutes common law unfair competition and constitutes misappropriation of trade secrets, and is unlawful for other reasons as well.
